1. About these terms
These Terms of Service govern your use of the website and services provided by Chip & Pin Direct ("we", "us", "our"), a card payment, telecoms and EPOS provider based at 50a Durham Road, Birtley, DH3 2QH. By using our website or taking our services, you agree to these terms. Specific services may also be covered by a separate service agreement, which will take precedence where there is any conflict.
2. Our services
We supply card payment machines, merchant services, online payments, broadband and telecoms, and EPOS systems to businesses, together with related support. The provision of card processing is subject to acceptance by our acquiring bank and to your business meeting the relevant approval checks. New merchant accounts are typically approved within 5 working days.
3. Pricing, fees and settlement
The charges for your services are set out in your quote or service agreement. Card processing fees, terminal rental and any telecoms or EPOS charges are payable as agreed. Where next-day settlement applies, your card takings are settled to your nominated business bank account on the next working day, subject to the daily cut-off time and to normal banking processes. All prices are in pounds sterling (£) and, unless stated otherwise, exclude VAT.
4. Equipment and support
Rented equipment remains our property and must be returned in good condition (fair wear and tear excepted) at the end of the service. You agree to use equipment in line with our guidance and to keep it reasonably secure. We work to a 24-hour repair-or-replace standard on faulty terminals as standard, with a faster response option available where required.
5. Your responsibilities
- Provide accurate business and bank details, and keep them up to date.
- Comply with the card scheme rules and PCI DSS requirements applicable to your business.
- Use the services lawfully and only for legitimate business transactions.
- Pay all charges due under your service agreement on time.
6. Term and cancellation
We believe in transparent, rolling terms with no unnecessary lock-ins. The minimum term, notice period and cancellation arrangements for your services are set out in your service agreement. Where no minimum term applies, either party may end the service by giving reasonable notice in writing.
7. Liability
Nothing in these terms limits our liability where it would be unlawful to do so. Subject to that, we are not liable for losses that are not reasonably foreseeable, or for loss of profits or business arising from circumstances outside our reasonable control, including third-party network, banking or card-scheme outages. Our total liability in connection with the services is limited to the charges paid by you for the relevant service.
8. Website use
The content of our website is provided for general information and may change without notice. The guides in our Help Centre are offered in good faith as practical guidance and do not replace tailored advice from our support team.
9. Governing law
These terms are governed by the laws of England and Wales, and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
